Warranty Policy

Limited Warranty for in2 SMART Device

The following Limited Warranty (“Warranty”) is provided by Virility Medical Ltd (“Virility” “we,” “us,” or “our”) to the original purchaser (“you” or “Customer”) of the in2 Smart (also known as vSmart) device, including its authorized accessories, electrodes, charging components provided at the time of sale (collectively, the “Device”). This Warranty is incorporated by reference into, and forms a part of, the Device’s labeling, user manual and any terms and conditions applicable to the sale and use of the Device.

The Device has received marketing authorization from the United States Food and Drug Administration (“FDA”), nothing in this Warranty expands, modifies, or alters those indications or any condition of clearance or approval imposed by the FDA. The Device is intended to be used as described in the user manual and not as a substitute for professional medical judgment, diagnosis, or treatment.

We encourage you to review this Warranty thoroughly to understand the terms and conditions under which your Device is covered. Should you have any questions or require assistance, customer support can provide support and guidance. Please note that by using the Device you are agreeing to be bound by the terms of this Warranty. For any warranty issues, please contact our Customer Service team at support@thein2.com. All Warranty services must be authorized and performed by Virility or authorized service provider listed.

The limited Warranty period begins on purchase date (of the original customer purchase) and continues for 12 months thereafter (“Warranty Period”).

We cannot control the quality of products sold by unauthorized sellers, this Warranty applies only to Devices that were purchased from us directly through our official website at: www.thein2.com, or from authorized seller in the United States, unless otherwise prohibited by law. Virility reserves the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized websites.

For the duration of the applicable Warranty Period, we warrant that the Device, when used, stored, and maintained strictly in accordance with the IFU. At our sole option, our responsibility under this Warranty is limited to the repair or replacement of any covered Device or component that we confirm to be defective. Repaired or replaced items are warranted for the remainder of the original Warranty Period.

This Warranty is not valid if the Device has been subject to an accident, misuse, abuse improper maintenance or repair, unauthorized modification, or any other use in combination with any electrode, cable, software, or ancillary product not supplied or approved in writing by Virility, including without limitations, used for any purpose other than the indications for use cleared or approved by the FDA. Please be advised that return shipping and any related fees are the responsibility of the customer, however, the shipping costs to send out any applicable replacement or repaired device will be covered by Virility.

Prior to initiating any warranty claim, it is recommended to review the Troubleshooting section of the User Manual and the Frequently Asked Questions (FAQ) available on our official website.

EXCEPT AS SPECIFICALLY PROVIDED IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIRILITY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL VIRILITY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
